In an effort to provide cost effective service to clients, the firm takes a dynamic approach to client management. We often hold an initial "strategy meeting" with the client to discuss objectives, strategies, budgeting, and fee arrangements. Our regular and recurring practice areas are outlined below.
APPELATE PRACTICE LITIGATION Business Litigation - The firm represents multiple clients whose business or commercial disputes result in litigation. Representative cases involve suits over contracts, leases, employment issues including violation of non-compete agreements, construction disputes, intellectual property disputes, real property and related issues including title/survey, foreclosures, etc, as well as complex landlord and tenant matters. Construction Litigation - The firm has extensive experience representing contractors, developers, builders, engineers, subcontractors and owners in construction matters. These matters often involve the failure to fulfill contractual obligations, mechanics liens, allegations of defects, and disagreements over financial responsibility. Insurance Litigation - The firm represents policy holders whose insurance companies refuse to honor insurance agreements. In some instances, the firm not only seeks compensatory damages, but may also ask for punitive damages. Personal Injury Litigation - While Burger Trailor & Farmer's attorneys have served as counsel in catastrophic personal injury lawsuits including wrongful death and survival actions arising from deaths by drowning, automobile accident, medical malpractice, our customary practice is to act as co-counsel with other firms that concentrate their practice on such matters. Real Property Litigation - The firm represents parties relating to boundary disputes and title issues, ADA Claims & disputes, landlords with respect to complex leasehold disputes and lenders relating to foreclosures, including complex multi party litigation. ALTERNATIVE DISPUTE RESOLUTION AND ARBITRATION BUSINESS RELATED MATTERS Corporate and Business Services - The firm represents small to mid size companies with their general corporate needs. This may include fund raising and securities compliance, SEC assistance, general business representation, such as assisting in the formation of corporations, purchase and sale of corporate stock or commercial assets, negotiation of employment agreements, non-compete agreements and confidentiality agreements. In addition we often prepare, review, and assist in the negotiation of business agreements, such as purchase agreements, license agreements, loan and guaranty agreements, employment contracts, joint venture agreements, or supply contracts. REAL PROPERTY RELATED MATTERS Closings - The firm assists clients in acquisitions of real property or business ventures. These acquisitions range from the acquisition of single family homes, or purchase or sale of raw land to purchase, sale or leasing of commercial shopping centers. We are also title agents for Fidelity National Title Insurance Company and we have closed transactions and loans for private and multinational lenders some of which loans are in the millions of dollars. Commercial Leasing - Firm clients own residential and commercial properties throughout South Florida and include some of the largest landowners in the State. The firm provides counseling to clients with ongoing commercial leasing needs and also provides litigation assistance for those matters which can not be resolved through negotiation or ADR. Representation of Builder Suppliers and Contractors -The firm represents suppliers to construction industry, construction companies and contractors in their respective ongoing business matters. We also provide assistance in contract negotiations. We are intimately familiar with the mechanics lien laws, bond claims and other areas of the construction process. |
